Legal Compliance

• Under Title III of the ADA, places of public accommodation (which may include websites offering goods or services to the public) must provide equal access to individuals with disabilities.

• Under Title II of the ADA, and as clarified in the newer rule issued by the U.S. Department of Justice on April 24, 2024, state and local government websites and mobile applications must comply with WCAG 2.1 AA or obtain equivalent access.

• In Missouri, the statute RSMo 161.935 (and related statutes) requires state agencies to procure, develop, maintain, or use information and communication technology that allows access comparable to individuals without disabilities. While this statute directly applies to state agencies, its standards reflect best practices for accessibility across the board.
